WAIVER AND RELEASE OF LIABILITY AGREEMENT

Please note that this is the agreement that will be delivered to you for signing to participate in the Retreat.

 
This is a legally binding agreement. Please read carefully before signing.

Event Dates: May 16th- 19th 2025
Location: Tulum, Mexico

 

1. Acknowledgment of Risks

By signing this agreement, I, the undersigned participant, acknowledge that I am voluntarily participating in the ORIGIN Retreat ("Retreat") organized by Jasmine Bee Inc. I understand that this Retreat involves physical activities, travel, and other experiences that may carry inherent risks, including but not limited to:

  • Accidents, injuries, or illnesses that may occur during transportation, activities, or while on the premises of the Retreat location.

  • Emotional or psychological stress arising from group interactions, personal coaching sessions, or immersive experiences.

  • Unforeseen circumstances that could result in physical or emotional harm.

I certify that I am in good health and capable of participating in all activities planned during the Retreat. I acknowledge that participation is entirely voluntary, and I assume full responsibility for any risks or injuries I may sustain.

 

2. Waiver of Liability

In consideration of being permitted to participate in the Retreat, I agree to release, waive, discharge, and hold harmless Jasmine Bee Inc., its agents, employees, contractors, and affiliates (collectively, "the Released Parties") from any and all claims, liabilities, demands, or causes of action arising from my participation in the Retreat. This release includes, but is not limited to, claims for personal injury, property damage, emotional distress, or wrongful death, whether caused by negligence or otherwise.

The Released Parties shall not be held liable for any incidental, indirect, or consequential damages, including but not limited to loss of enjoyment, travel costs, or personal expenses incurred as a result of participating in or canceling the Retreat.

3. Code of Conduct

I agree to conduct myself with respect toward all participants, organizers, and staff throughout the Retreat. Any disruptive, unsafe, or inappropriate behavior may result in my removal from the Retreat without refund.

4. No Refund Policy

I acknowledge and agree that all monies paid for the Retreat are non-refundable. This includes, but is not limited to, deposits, full payments, or any other fees associated with the Retreat. If I am unable to attend the Retreat for any reason, including but not limited to personal emergencies, illness, or travel disruptions, I understand that I will not receive a refund. My sole remedy will be the opportunity to apply my payment toward a future service hosted by Jasmine Bee Inc., but there is no guarantee of future events.

5. Force Majeure

In the event of circumstances beyond the control of the Retreat organizers (including but not limited to Jasmine Bee being ill, natural disasters, pandemics, travel restrictions, or acts of God), the Retreat may be rescheduled. If I am unable to attend the rescheduled date, my sole remedy will be the opportunity to apply my payment toward a future retreat hosted by Jasmine Bee. No refunds will be issued under any circumstances.

The organizers shall not be held liable for cancellations or interruptions caused by third-party vendors, venue unavailability, or changes to the program resulting from unforeseen circumstances.

6. Services and Availability

I acknowledge that the services, amenities, and experiences offered as part of the Retreat, including but not limited to wellness treatments, healing sessions, fitness classes, and guided activities, are subject to availability and may change at the discretion of the Retreat location or Jasmine Bee Inc.

I understand that all services are governed by third-party vendors' policies, and Jasmine Bee Inc. has no control over their availability. No refunds or compensation will be issued for modifications or unavailability of services beyond the organizers' control.

7. Alcohol and Substances

I acknowledge that if I choose to consume alcohol or any other substances during the Retreat, I do so voluntarily and at my own risk. I assume full responsibility for my actions, decisions, and any consequences that may arise. The Released Parties bear no liability for any injury, harm, or loss resulting from my consumption of alcohol or other substances.

Additionally, I agree to abide by all venue policies and Retreat guidelines regarding alcohol and substance consumption. Any failure to comply may result in my removal from the Retreat without refund.

8. Medical Treatment

I acknowledge that I am solely responsible for my own health and medical needs during the Retreat. I agree to inform the organizers of any medical conditions, allergies, or other concerns that may affect my participation. I authorize the organizers to seek emergency medical treatment on my behalf if necessary and agree to solely bear all costs associated with such treatment.

In the event of an emergency requiring evacuation or other unplanned transportation, I acknowledge that I am responsible for any associated costs.

9. COVID-19 and Communicable Diseases

I acknowledge the risks associated with potential exposure to COVID-19 or other communicable diseases during the Retreat. I agree to follow all health and safety guidelines set by the organizers and venue. I release the organizers from any liability related to illness.

10. Photo and Media Release

I grant permission for my image, likeness, and any statements made during the Retreat to be used in promotional materials, social media, and other media by Jasmine Bee Inc. I understand that I will not receive any compensation for such use.

If I do not wish to have my image, likeness, or statements used for promotional purposes, I will notify the organizers in writing before the Retreat begins.

11. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada. Any disputes arising from this agreement shall be resolved exclusively in the courts within the jurisdiction of British Columbia.

12. Severability

If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

13. Acknowledgment of Understanding

I have read and fully understand this waiver and release of liability. I understand that by signing this agreement, I am waiving my right to bring any legal action against the Released Parties for any injury, loss, or damage resulting from my participation in the Retreat. I sign this agreement voluntarily and with full knowledge of its contents.
